References in these Terms & Conditions to “we”, “us” or “our” mean Richard Randall trading as Cosy Living Stoves.

References to “you” or “the customer” mean the person purchasing goods and/or chimney sweeping services from us.

2. What We Supply

Cosy Living Stoves supplies:

  • stoves;
  • hearths; and
  • chimney sweeping services

Unless expressly agreed otherwise in writing, Cosy Living Stoves does not supply installation labour, flue systems, flue components or other materials required for installation.

Where you require installation, these materials and services are supplied separately by Richard Randall Woodburners Limited.

Although Cosy Living Stoves and Richard Randall Woodburners Limited work together to provide a coordinated service, they are separate contracting parties and each is responsible for the goods or services it supplies.

3. Consultation, Stove Selection and Quotations

Before recommending a stove, we will discuss your requirements and may take into account information obtained during a survey of your property.

Our quotation will normally identify:

  • the stove to be supplied;
  • manufacturer and model;
  • size and output;
  • fuel type;
  • colour and finish;
  • hearth, where applicable;
  • accessories supplied by Cosy Living Stoves;
  • price;
  • any deposit required; and
  • anticipated supply arrangements.

Any installation requirements discussed when selecting your stove are relevant to determining the suitability of the appliance but do not make Cosy Living Stoves the provider of the installation service.

Installation requirements and costs will be covered separately by Richard Randall Woodburners Limited.

4. Acceptance of Your Quotation

Your contract with Richard Randall trading as Cosy Living Stoves is formed when you accept our quotation or order in accordance with the acceptance instructions provided.

Please check all details carefully before accepting, particularly:

  • stove manufacturer and model;
  • size and output;
  • fuel type;
  • colour and finish;
  • hearth;
  • accessories; and
  • any other customer-selected options.

If anything is incorrect, you must tell us as soon as possible.

Once a stove or hearth has been ordered, particularly where it has been manufactured, painted, finished, cut or configured specifically for you, it may not be possible to change the specification without additional cost.

Your contract with Cosy Living Stoves is for the goods and/or chimney sweeping services identified as being supplied by Cosy Living Stoves.

Any contract for installation materials or installation services is a separate contract with Richard Randall Woodburners Limited.

5. Stove Selection and Suitability

We will use reasonable care and skill when recommending a stove based upon the information available to us, our understanding of the property and your stated requirements.

The suitability of any stove is also subject to the physical conditions at the property and the requirements of the proposed installation.

Stove performance can be affected by factors including:

  • the building;
  • insulation and heat loss;
  • chimney and flue;
  • ventilation;
  • fuel;
  • weather conditions; and
  • the way in which the appliance is operated.

The installation itself is the responsibility of Richard Randall Woodburners Limited where you contract with that company for installation.

Where the property is situated within a Smoke Control Area, the appliance and fuel must comply with applicable requirements.

6. Customer Responsibilities

You agree to:

  • provide accurate information about your requirements and property where relevant to stove selection;
  • tell us about any circumstances you know may affect the suitability of the stove;
  • carefully check the model, specification, dimensions, colour, finish and hearth before ordering; and
  • follow the manufacturer’s operating and maintenance instructions once the stove has been installed.

You are responsible for obtaining any landlord, freeholder, leaseholder or other permission required to purchase or install the appliance unless expressly agreed otherwise.

7. Special-Order, Bespoke and Customer-Specified Products

Many stoves and hearths are ordered specifically for an individual customer.

This may include selection of a particular:

  • stove model;
  • size or configuration;
  • colour;
  • paint finish;
  • door or handle option;
  • hearth material;
  • hearth dimensions or shape; or
  • other customer-selected specification.

Where a product is made to your individual specification or clearly personalised, including certain non-standard or specially commissioned colours, finishes, dimensions or configurations, it may constitute a bespoke or personalised product.

Where reasonably practicable, your quotation or order documentation will identify products which are being specially manufactured, altered, painted, cut or finished to your individual requirements.

Once manufacture, painting, cutting, finishing or other bespoke work has commenced, statutory cancellation rights may not apply where the law provides an exemption for goods made to a consumer’s specification or clearly personalised.

Selecting a colour, finish or other option from a manufacturer’s normal standard range does not automatically mean that the product is legally a bespoke or personalised item.

Please therefore check the model, colour, finish, dimensions and specification carefully before accepting your quotation.

Nothing in this section affects your statutory rights where goods are faulty, not as described, not of satisfactory quality or otherwise fail to conform to the contract.

8. Deposits and Payment

Any deposit required will be stated on your Cosy Living Stoves quotation or order documentation.

The price for any stove, hearth and/or chimney sweeping service must be paid in accordance with the payment terms stated on our quotation, booking confirmation or invoice.

Payments due to Cosy Living Stoves are separate from payments due to Richard Randall Woodburners Limited for installation materials and installation services.

Where payment becomes overdue, we reserve the right to suspend supply of the relevant goods, provided that doing so is lawful and reasonable in the circumstances.

This may affect a planned installation date if the stove or hearth is required before installation can proceed.

Goods supplied by us remain our property until payment for those goods has been received in full, to the extent permitted by law.

Nothing in this section affects your statutory consumer rights.

9. Cancellation

Your cancellation rights may depend upon how and where your contract with Cosy Living Stoves is concluded.

Where you have a statutory right to cancel, we will provide the cancellation information required by law.

Bespoke and Personalised Goods

Statutory cancellation rights applicable to standard goods may not apply to goods made to your specifications or clearly personalised.

This may include certain stoves or hearths specially manufactured, altered, painted, cut or finished to a genuinely individual specification.

Other Special-Order Goods

Where a product has been specially ordered for you but does not legally qualify as a bespoke or personalised product, the fact that it was specially ordered does not automatically remove any statutory cancellation right you may have.

Where no statutory cancellation right applies and you nevertheless ask to cancel an accepted order, we will consider whether cancellation can reasonably be accommodated.

Any cancellation charge will be reasonable and will reflect costs or losses that we are legally entitled to recover.

We will not impose a disproportionate cancellation charge or automatically retain a deposit where we have no legal entitlement to do so.

Nothing in these Terms & Conditions affects your statutory rights.

Separate Installation Contract

Cancellation of your stove or hearth order with Cosy Living Stoves does not automatically cancel any separate contract you have entered into with Richard Randall Woodburners Limited.

If you wish to cancel both contracts, you should make this clear.

10. Changes to an Order

If you wish to change the stove, colour, finish, hearth, accessories or other specification after accepting your quotation, please contact us as soon as possible.

We will try to accommodate changes where reasonably possible.

However, once products have been ordered, manufactured, painted, altered, cut, finished or dispatched, changes may not be possible or may result in additional charges.

We will explain any additional costs before agreeing a requested change.

A change to your stove or hearth may also affect your installation. Any resulting changes to installation materials or installation work should be agreed separately with Richard Randall Woodburners Limited.

11. Delivery and Supply

We will arrange the supply of the stove and/or hearth in accordance with the arrangements agreed with you.

Where the stove or hearth is being installed by Richard Randall Woodburners Limited, delivery may be coordinated with the installation for convenience.

This does not mean that Richard Randall Woodburners Limited supplied the stove or hearth or that Cosy Living Stoves supplied the installation service.

Delivery dates may depend upon manufacturer and supplier availability, particularly for special-order, painted, made-to-measure or bespoke products.

Any anticipated delivery date is subject to availability unless expressly agreed otherwise.

If a significant delay occurs, we will inform you as soon as reasonably practicable.

Nothing in this section limits your rights or remedies under consumer law.

12. Fuels and Operation

Only fuels suitable for your particular appliance should be used.

You must comply with the appliance manufacturer’s requirements and applicable environmental legislation concerning permitted fuels.

Using unsuitable, excessively wet or prohibited fuel may:

  • reduce appliance performance;
  • cause excessive deposits;
  • damage the appliance or flue;
  • increase emissions;
  • create a safety risk; and/or
  • affect a manufacturer’s warranty.

13. Maintenance, Servicing and Chimney Sweeping

Your stove must be appropriately operated and maintained.

The appliance should be inspected and serviced in accordance with the manufacturer’s recommendations.

Your chimney and flue should also be swept and maintained at appropriate intervals according to the type and frequency of use, fuel burned, manufacturer’s instructions and professional advice.

Failure to operate, sweep, service or maintain the appliance and flue correctly can affect performance and safety and may affect any applicable manufacturer’s warranty.

Chimney Sweeping Services

Cosy Living Stoves also provides chimney sweeping services.

Where you instruct us to carry out a chimney sweep, we will perform the service with reasonable care and skill.

A chimney sweep is intended to remove soot, deposits and other material that can reasonably be removed using the appropriate sweeping method. It does not constitute a full structural survey or guarantee the condition, integrity or future performance of the chimney, flue, liner, appliance or associated components.

During sweeping, previously unknown defects or problems may become apparent, including damaged or deteriorated liners, blockages, excessive deposits, unsuitable installations or other conditions affecting the chimney or flue.

Where we identify an apparent defect or safety concern, we will bring this to your attention where reasonably practicable. Further investigation, remedial work or replacement may be recommended and would be subject to separate agreement.

We are not responsible for pre-existing defects in the chimney, flue, liner, stove or property, or for defects that could not reasonably have been identified during the chimney sweeping service.

You should tell us before the sweep about any known problems with the appliance, chimney or flue and provide reasonable and safe access to the appliance and chimney.

Where appropriate, evidence or confirmation of the chimney sweeping service will be provided following completion.

Nothing in this section affects your statutory consumer rights.

14. Your Consumer Rights: Stove and Hearth Supply and Chimney Sweeping

Goods supplied by Cosy Living Stoves must comply with applicable consumer law, including requirements concerning satisfactory quality, fitness for purpose where applicable and conformity with their description.

Where a manufacturer’s warranty applies to a stove or hearth, details will be provided or made available where applicable.

A manufacturer’s warranty is additional to your statutory consumer rights and does not replace those rights.

Chimney sweeping services will be carried out with reasonable care and skill in accordance with applicable consumer law.

Nothing in these Terms & Conditions removes or restricts any statutory consumer right or remedy that cannot lawfully be excluded.

15. Faults With a Stove or Hearth

If you believe there is a fault with a stove or hearth supplied by Cosy Living Stoves, please contact us as soon as reasonably possible.

We should normally be given a reasonable opportunity to inspect the product and investigate the problem and, where appropriate, provide the remedy for which we are legally responsible.

Sometimes it may initially be unclear whether a problem arises from the stove itself or from the installation, flue, fuel or another cause.

Where appropriate, Cosy Living Stoves may cooperate with Richard Randall Woodburners Limited in investigating the cause.

This does not change the contractual responsibilities of either business.

If you believe the appliance or installation is unsafe, stop using it and seek appropriate professional assistance.

Nothing in this section prevents you exercising your statutory rights.

16. Manufacturer Specifications and Product Appearance

Product information, photographs, dimensions and specifications provided by manufacturers or displayed on our website or literature should be treated as guidance unless expressly incorporated into your contract.

Manufacturers may occasionally alter specifications.

Photographs are illustrative, and colours and finishes can appear differently depending upon lighting, printed materials and computer or mobile-device screens.

Natural hearth materials may have variations in colour, pattern, veining, texture and appearance.

Where colour, finish or appearance is particularly important, please discuss this with us before accepting your quotation.

17. Our Website

The Cosy Living Stoves website provides information about our business and the stoves and hearths we may be able to supply.

It may also provide information about installation services available separately from Richard Randall Woodburners Limited.

Information about installation on the website does not mean that Cosy Living Stoves is the provider of those installation services.

Viewing a stove or hearth on our website does not itself constitute an offer to sell that product.

The model, specification, colour, finish, price and other details applicable to your purchase will be those confirmed in your quotation and associated order documentation.

18. Liability

Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded under consumer protection legislation.

Cosy Living Stoves is responsible for the stove and/or hearth it supplies to the extent required by law.

Cosy Living Stoves is not the supplier of installation services or installation materials supplied under a separate contract with Richard Randall Woodburners Limited.

We will not be responsible for losses caused by circumstances for which we are not legally responsible.

Subject always to your statutory rights, this may include faults or losses resulting from:

  • misuse of the appliance;
  • use of unsuitable fuel;
  • failure to maintain or service the appliance appropriately;
  • failure to maintain or sweep the chimney/flue appropriately;
  • unauthorised alterations;
  • work subsequently undertaken by another contractor; or
  • pre-existing defects within the property,

except to the extent that Cosy Living Stoves is legally responsible for the relevant loss or damage.

19. Complaints

Nothing in these Terms & Conditions is intended to remove, restrict or replace your statutory consumer rights.

Goods supplied to consumers must meet the requirements imposed by applicable consumer law.

Where these Terms & Conditions conflict with a statutory consumer right which cannot lawfully be excluded or restricted, the statutory right will apply.

21. Privacy and Personal Information

We will process your personal information in accordance with applicable UK data-protection legislation and our Privacy Policy.

Our website Privacy Policy and Cookie Policy are separate from these Terms & Conditions.

Where you are also obtaining installation services from Richard Randall Woodburners Limited, relevant information may need to be shared with that company for purposes connected with your enquiry, quotation, order, delivery, installation, warranty or aftercare.

22. Governing Law

These Terms & Conditions and your contract with Richard Randall trading as Cosy Living Stoves are governed by the applicable law of the United Kingdom.

If you are a consumer, nothing in this section removes any rights you have to bring proceedings in the part of the United Kingdom in which you live where applicable.

23. Changes to the Contract

The Terms & Conditions applying to your purchase will be the version provided or made available when your contract with Cosy Living Stoves is entered into.

If either you or Cosy Living Stoves subsequently wishes to make a material change to the agreed goods, chimney sweeping services, specification or price, the change will be discussed and agreed where required before the relevant amended supply or service is undertaken.

24. Entire Agreement

Your Cosy Living Stoves quotation or booking, agreed specification where applicable, these Terms & Conditions and any other documents expressly incorporated into the agreement form the basis of your contract with Richard Randall trading as Cosy Living Stoves for the supply of your stove and/or hearth and/or the provision of chimney sweeping services.

Your separate agreement with Richard Randall Woodburners Limited for installation materials and installation services does not form part of this contract except where expressly stated.

Nothing in the contract excludes any consumer right or remedy which cannot legally be excluded or restricted.
