References in these Terms & Conditions to “we”, “us” or “our” mean Richard Randall Woodburners Limited.
References to “you” or “the customer” mean the person entering into the installation contract with us.
2. What We Supply
Richard Randall Woodburners Limited is responsible for:
- materials required for installation;
- flue systems and flue components;
- ventilation components where required;
- installation accessories and associated materials;
- labour;
- installation works;
- commissioning; and
- applicable installation compliance procedures.
The precise materials and work included will be identified in your quotation or associated documentation.
Stove and Hearth
Unless expressly stated otherwise, the stove and hearth are not supplied by Richard Randall Woodburners Limited.
Where purchased through Cosy Living Stoves, the stove and hearth are supplied separately by Richard Randall trading as Cosy Living Stoves under its Terms & Conditions: Supply of Stove/Hearth.
The two businesses may coordinate your project, but they are separate contracting parties and each is responsible for the goods or services it supplies.
3. Site Surveys and Installation Quotations
Before carrying out installation work, we will discuss your requirements and, where appropriate, carry out a survey of the property.
Our installation quotation will normally identify:
- principal installation work;
- flue system and components;
- other installation materials;
- ventilation requirements where known;
- known additional works;
- price;
- any deposit required; and
- anticipated installation arrangements.
Our quotation is based upon the information available to us and conditions that can reasonably be assessed at the time of the survey.
Certain parts of a chimney, fireplace, flue or building structure may be concealed and cannot always be fully assessed until installation work begins.
Unless otherwise stated, a quotation is not an assurance that no additional work or materials will become necessary if previously concealed or unforeseen conditions are subsequently discovered.
Where material additional work is required, we will explain the reason and any additional charge and seek your agreement before proceeding wherever reasonably practicable.
4. Acceptance of Your Installation Quotation
Your contract with Richard Randall Woodburners Limited is formed when you accept our installation quotation or otherwise instruct us in accordance with the acceptance arrangements provided.
Please check the installation details carefully before accepting, particularly:
- proposed stove and its installation requirements;
- flue specification;
- ventilation requirements;
- installation materials;
- hearth/fireplace arrangements relevant to installation;
- accessories;
- works included;
- works excluded; and
- price.
If anything is incorrect, you must tell us as soon as possible.
Your installation contract is separate from any contract you have with Cosy Living Stoves for the purchase of your stove and/or hearth.
5. Suitability of the Proposed Installation
We will use reasonable care and skill when assessing and recommending an installation based upon the information available to us, our assessment of the property and your stated requirements.
The final installation is subject to:
- physical conditions at the property;
- chimney and fireplace condition;
- ventilation requirements;
- the selected appliance;
- manufacturer’s installation instructions;
- Building Regulations;
- applicable technical requirements; and
- safety considerations.
We will not knowingly complete an installation that we believe to be unsafe or non-compliant.
6. HETAS, Building Regulations and Installation Standards
Where installation work falls within the scope of our HETAS registration, the work will be undertaken and/or supervised by a suitably competent HETAS Registered Installer within the appropriate categories of competence.
Installation work will be carried out in accordance with applicable:
- Building Regulations;
- manufacturer’s installation instructions; and
- technical and safety requirements.
Where the completed installation is eligible and required to be notified through the HETAS Competent Person Scheme, Richard Randall Woodburners Limited will arrange the appropriate notification following completion of the installation.
Relevant commissioning and compliance documentation will be completed and/or provided as applicable.
You should retain documentation relating to the installation, as it may be required for insurance purposes or when the property is subsequently sold.
Where we use another appropriately qualified person or subcontractor to carry out part of an installation for which Richard Randall Woodburners Limited holds the contract with you, this does not remove our responsibilities to you under our contract.
7. Customer Responsibilities
You agree to:
- provide accurate information about the property and your requirements;
- tell us about known defects affecting the fireplace, chimney, flue or surrounding structure;
- tell us about relevant previous building, fireplace or chimney work;
- inform us of any known asbestos or other hazardous materials;
- provide reasonable and safe access to the property;
- ensure the installation area is reasonably clear before work begins;
- provide access to services where reasonably required;
- keep children and pets safely away from the working area; and
- follow the manufacturer’s operating and maintenance instructions following installation.
Unless expressly included within our quotation, you are responsible for obtaining permissions such as:
- landlord consent;
- freeholder consent;
- leaseholder consent;
- planning permission; or
- listed-building consent,
where required.
8. Installation Materials and Special-Order Components
Installation materials supplied by us may include products ordered specifically for your property and proposed installation.
These may include:
- flue components;
- chimney liners;
- terminals;
- adaptors;
- ventilation components;
- register plates;
- fireplace components;
- installation accessories; and
- other specialist materials.
Where an installation component is made to your individual specification or clearly personalised, statutory cancellation rights may not apply where the law provides an applicable exemption.
The fact that a component has simply been specially ordered for your project does not automatically mean that it is legally a bespoke or personalised product.
Nothing in this section affects your statutory rights where goods supplied by us are faulty, not as described, not of satisfactory quality or otherwise fail to conform to the contract.
9. Deposits and Payment
Any deposit required will be stated on our quotation or order documentation.
The balance for installation materials and installation services must be paid in accordance with the payment terms stated on our quotation or invoice.
Payments due to Richard Randall Woodburners Limited are separate from any payments due to Cosy Living Stoves for your stove and/or hearth.
Where payment becomes overdue, we reserve the right to suspend further work or withhold installation until payment arrangements have been resolved, provided that doing so is lawful and reasonable in the circumstances.
Goods supplied by us remain our property until payment for those goods has been received in full, to the extent permitted by law.
Nothing in this section affects your statutory consumer rights.
10. Cancellation
Your cancellation rights may depend upon how and where your contract with Richard Randall Woodburners Limited is concluded.
Where you have a statutory right to cancel the contract, we will provide the cancellation information required by law.
Where you ask us to begin installation services during an applicable statutory cancellation period, we may require your express request before commencing work.
If you subsequently exercise a statutory right to cancel, you may be required to pay a proportionate amount for services properly provided before cancellation where the law permits us to make such a charge.
Where materials have been made to your specifications or clearly personalised, applicable statutory cancellation rights may not apply where the law provides an exemption.
Where a material has been specially ordered for your installation but does not legally qualify as bespoke or personalised, this does not automatically remove any statutory cancellation right you may have.
Where no statutory cancellation right applies and you nevertheless ask to cancel, we will consider whether cancellation can reasonably be accommodated.
Any cancellation charge will be reasonable and will reflect costs or losses that we are legally entitled to recover.
We will not impose a disproportionate cancellation charge or automatically retain a deposit where we have no legal entitlement to do so.
Nothing in these Terms & Conditions affects your statutory rights.
Separate Stove/Hearth Contract
Cancellation of your installation contract with Richard Randall Woodburners Limited does not automatically cancel an order for a stove or hearth placed with Richard Randall trading as Cosy Living Stoves.
If you wish to cancel both contracts, you should make this clear.
11. Changes to the Installation
If you wish to change the agreed installation after accepting your quotation, please contact us as soon as possible.
We will try to accommodate changes where reasonably possible.
However, once materials have been ordered, manufactured, altered or dispatched, changes may not be possible or may result in additional charges.
Changes to the stove or hearth selected under your separate contract with Cosy Living Stoves may require corresponding changes to:
- flue components;
- distances to combustibles;
- hearth arrangements;
- fireplace preparation;
- ventilation;
- installation method; or
- other installation materials or work.
We will explain any material additional costs before agreeing a requested change.
12. Availability of Stove and Hearth
Where the stove and/or hearth is being supplied separately by Cosy Living Stoves, our ability to carry out the installation may depend upon those goods being available.
We will coordinate installation arrangements where reasonably practicable.
However, Richard Randall Woodburners Limited is not the supplier of a stove or hearth supplied under a separate contract with Cosy Living Stoves.
A delay in availability of the stove or hearth may require the installation date to be rearranged.
13. Installation Dates and Delays
We will make reasonable efforts to carry out your installation on the date agreed with you.
Occasionally circumstances outside our reasonable control may cause delays. These can include:
- manufacturer or supplier delays;
- delays affecting the stove or hearth;
- bespoke manufacturing delays;
- adverse weather;
- illness;
- unsafe working conditions;
- problems with access;
- availability of specialist components; or
- previously concealed problems discovered at the property.
If a significant delay occurs, we will inform you as soon as reasonably practicable and arrange an alternative date where necessary.
Nothing in this section limits any rights or remedies available to you under consumer law.
14. Unforeseen Installation Work
Our initial survey is necessarily limited to those areas of the property that can reasonably be inspected without opening up or dismantling the existing structure.
During installation, previously concealed conditions may become apparent.
These can include, for example:
- defects within an existing chimney;
- damaged or unsuitable flues;
- previously undisclosed alterations;
- inadequate fireplace construction;
- structural defects;
- unsuitable existing hearths;
- inadequate ventilation;
- hidden combustible materials;
- obstructions;
- unexpected pipework or wiring; or
- other conditions affecting the safety or compliance of the installation.
If additional work or materials become necessary for a safe and compliant installation, we will explain the issue and any additional charge before proceeding wherever reasonably practicable.
Where an immediate decision is required for safety or to prevent damage, we will act reasonably in the circumstances.
We will not knowingly complete an installation that we believe to be unsafe or non-compliant.
15. Making Good and Decoration
We will take reasonable care when working within your property.
The quotation will specify any making-good work included within the agreed installation.
Unless expressly included in your quotation, our installation does not include subsequent:
- decorating;
- painting;
- specialist plastering;
- flooring;
- joinery; or
- other cosmetic finishing work.
We are not responsible for pre-existing defects or for damage resulting from weaknesses or defects within the property that could not reasonably have been identified before work commenced, except to the extent that we are legally responsible for the relevant loss or damage.
Nothing in these Terms & Conditions excludes or restricts liability where it would be unlawful to do so.
16. Commissioning and Handover
Following installation, the stove will be commissioned as appropriate.
We will provide relevant information concerning:
- safe operation of the appliance;
- suitable fuels;
- maintenance;
- servicing requirements; and
- chimney sweeping.
Where applicable, relevant installation and commissioning documentation will be completed and provided or made available.
You are responsible for operating the appliance in accordance with the manufacturer’s instructions and information provided at handover.
17. Fuels
Only fuels suitable for your particular appliance should be used.
You must comply with the appliance manufacturer’s requirements and applicable environmental legislation concerning permitted fuels.
Using unsuitable, excessively wet or prohibited fuel may:
- reduce appliance performance;
- cause excessive deposits;
- damage the appliance or flue;
- increase emissions;
- create a safety risk; and/or
- affect a manufacturer’s warranty.
18. Maintenance, Servicing and Chimney Sweeping
Your stove, chimney and flue system must be appropriately maintained.
The chimney/flue should be swept at appropriate intervals according to:
- the type and frequency of use;
- fuel burned;
- manufacturer’s instructions; and
- appropriate professional advice.
The appliance should also be inspected and serviced in accordance with the manufacturer’s recommendations.
Failure to operate, sweep, service or maintain the appliance and flue correctly can affect its performance and safety and may affect any applicable manufacturer’s warranty.
19. Installation Materials, Services and Consumer Rights
Installation materials supplied by Richard Randall Woodburners Limited must comply with applicable consumer law, including applicable requirements concerning satisfactory quality, fitness for purpose and conformity with description.
Installation services will be provided with reasonable care and skill.
Where a manufacturer’s warranty applies to an installation component, details will be provided or made available where applicable.
A manufacturer’s warranty is additional to your statutory consumer rights and does not replace those rights.
Nothing in these Terms & Conditions removes or restricts any statutory consumer right or remedy that cannot lawfully be excluded.
20. Faults and Installation Problems
If you believe there is a problem with the installation or installation materials supplied by us, please contact us as soon as reasonably possible.
We should normally be given a reasonable opportunity to inspect the installation and, where appropriate, rectify a problem for which we are responsible.
Please do not arrange for another contractor to alter our installation before giving us a reasonable opportunity to investigate, except where urgent action is reasonably necessary for safety.
Where it is initially unclear whether a problem arises from the installation or from the stove/hearth supplied separately by Cosy Living Stoves, we may cooperate with Cosy Living Stoves in investigating the cause.
This does not change the contractual responsibility of either business.
If you believe the appliance or installation is unsafe, stop using it and seek appropriate professional assistance.
Nothing in this section prevents you exercising your statutory rights.
21. Manufacturer Specifications
Product information, dimensions and specifications relating to installation components are based upon information available from the relevant manufacturers and suppliers.
Manufacturers may occasionally alter specifications.
Where such a change materially affects your installation, we will discuss any necessary change with you wherever reasonably practicable.
22. Liability
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded under consumer protection legislation.
Richard Randall Woodburners Limited is responsible for the installation materials and installation services it supplies to the extent required by law.
We are not the supplier of a stove or hearth supplied separately by Richard Randall trading as Cosy Living Stoves.
We will not be responsible for losses caused by circumstances for which we are not legally responsible.
Subject always to your statutory rights, this may include faults or losses resulting from:
- misuse of the appliance;
- use of unsuitable fuel;
- failure to maintain or sweep the appliance/flue appropriately;
- failure to follow manufacturer instructions;
- unauthorised alterations to the installation;
- work subsequently undertaken by another contractor; or
- pre-existing defects in the property that were not caused by our work,
except to the extent that we are legally responsible for the relevant loss or damage.

24. Statutory Rights
Nothing in these Terms & Conditions is intended to remove, restrict or replace your statutory consumer rights.
Goods supplied to consumers must meet the requirements imposed by applicable consumer law and installation services must be carried out with reasonable care and skill.
Where these Terms & Conditions conflict with a statutory consumer right which cannot lawfully be excluded or restricted, the statutory right will apply.
25. Privacy and Personal Information
We will process your personal information in accordance with applicable UK data-protection legislation and the relevant Privacy Policy.
Personal information may need to be used for purposes connected with:
- your enquiry;
- survey;
- quotation;
- installation;
- HETAS and Building Regulations compliance;
- warranties;
- complaints; and
- aftercare.
Where your stove or hearth is supplied by Cosy Living Stoves, relevant information may need to be shared with that business for purposes connected with coordinating your project, investigating faults, warranties and aftercare.
Further information about how personal information is used and shared should be contained within the applicable Privacy Policy.
26. Governing Law
These Terms & Conditions and your contract with Richard Randall Woodburners Limited are governed by the applicable law of the United Kingdom.
If you are a consumer, nothing in this section removes any rights you have to bring proceedings in the part of the United Kingdom in which you live where applicable.
27. Changes to the Contract
The Terms & Conditions applying to your installation will be the version provided or made available when your installation contract is entered into.
If either you or Richard Randall Woodburners Limited subsequently wishes to make a material change to the agreed work, materials, specification or price, the change will be discussed and agreed where required before the relevant additional or amended work is undertaken.
28. Entire Agreement
Your installation quotation, agreed specification, these Terms & Conditions and any other documents expressly incorporated into the agreement form the basis of your contract with Richard Randall Woodburners Limited for installation materials and installation services.
Your separate agreement with Richard Randall trading as Cosy Living Stoves for the supply of your stove and/or hearth does not form part of this contract except where expressly stated.
Nothing in the contract excludes any consumer right or remedy which cannot legally be excluded or restricted.
